INTRODUCTION

These Terms and Conditions ("Terms") govern your use of SKYDECK Hotel & Resorts Private Limited ("SKYDECK", "Hotel", "we", "our", or "us") services, including hotel reservations, stays, dining, events, and use of our website and mobile applications (collectively, "Services").

By accessing our Services, making a reservation, or staying at our hotel, you agree to be bound by these Terms. Please read them carefully.

Important: If you do not agree to these Terms, you must not use our Services or make reservations with us.

ORDER RULES & BOOKING TERMS

Reservation Requirements

All reservations require:

  • Valid government-issued photo ID
  • Credit/debit card for guarantee and incidentals
  • Full payment or deposit as per the rate plan
  • Minimum age of 18 years for check-in

Payment Terms

Guarantee & Authorization

  • All reservations require a valid credit/debit card guarantee
  • We authorize your card for the full stay amount plus incidentals (typically $100/night) at check-in
  • Actual charges are processed at check-out
  • Prepaid rates require full payment at time of booking

Cancellation Policy

USER RESPONSIBILITIES

Guest Conduct

All guests must:

  • Comply with all hotel policies and local laws
  • Respect other guests' peace and privacy
  • Use hotel property responsibly and report any damages
  • Supervise children at all times
  • Not engage in illegal activities on hotel premises
Zero Tolerance: We reserve the right to evict without refund any guest engaging in disruptive, dangerous, or illegal behavior.

Account Security

If you create an account with us, you are responsible for:

  • Maintaining confidentiality of your login credentials
  • All activities under your account
  • Promptly notifying us of unauthorized access
  • Ensuring account information is accurate and current

Damage & Loss Responsibility

Guest Liabilities

Guests are financially responsible for:

  • Damage to hotel property beyond normal wear and tear
  • Missing items from rooms or common areas
  • Excessive cleaning required due to guest actions
  • Smoking in non-smoking areas ($250 cleaning fee)
  • Lost room keys or access cards ($50 replacement fee)

SERVICE RULES & HOTEL POLICIES

Check-in & Check-out

  • Check-in: 3:00 PM | Check-out: 11:00 AM
  • Early check-in and late check-out subject to availability and fees
  • Guaranteed late check-out until 2:00 PM: $75
  • Baggage storage available before check-in and after check-out

Occupancy & Room Use

  • Maximum room occupancy strictly enforced
  • Additional guests beyond stated capacity: $50/night
  • No unauthorized visitors in guest rooms after 10:00 PM
  • Rooms cannot be used for commercial purposes without prior approval
  • No parties or events in guest rooms

Hotel Facilities

Pool & Fitness Center

  • Open 6:00 AM to 10:00 PM daily
  • Children under 16 must be accompanied by an adult
  • Proper swimwear required
  • No glass containers in pool area
  • Use equipment at your own risk

Pet Policy

  • Pets allowed only in designated pet-friendly rooms
  • Pet fee: $100 per stay (non-refundable)
  • Maximum 2 pets per room under 50 lbs each
  • Pets must be leashed in public areas
  • Owner responsible for any damages or disturbances

Smoking Policy

Strict Non-Smoking Policy: All indoor areas are non-smoking. Smoking is permitted only in designated outdoor areas. Violation incurs a $250 cleaning fee.

DISPUTE RESOLUTION TERMS

Complaint Procedure

  1. Immediate Resolution: Report any issues during your stay to front desk for immediate assistance
  2. Formal Complaint: Submit written complaint within 7 days of check-out to guestrelations@skydeckhotel.com
  3. Investigation: We will investigate and respond within 14 business days
  4. Resolution: We will propose a resolution based on our findings

Charge Disputes

Credit Card Disputes

If you dispute a charge:

  • Contact us first at accounting@skydeckhotel.com
  • Provide supporting documentation
  • We will investigate and respond within 30 days
  • Filing a chargeback without contacting us first may result in account suspension

Arbitration Agreement

Binding Arbitration

By using our Services, you agree that any dispute, claim or controversy arising out of or relating to these Terms or your stay shall be resolved by binding arbitration rather than in court.

  • Governing Law: New York State law
  • Class Action Waiver: All claims must be brought in individual capacity, not as class actions

Limitation of Liability

SKYDECK Hotel's total liability for any claim shall not exceed the total amount paid by you for the specific reservation giving rise to the claim.

We are not liable for:

  • Loss or damage to personal property (use in-room safe)
  • Personal injury except due to our gross negligence
  • Events beyond our reasonable control (force majeure)
  • Third-party services arranged through the hotel

ADDITIONAL TERMS

Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, weather events
  • Government actions, travel restrictions
  • Utility failures, strikes
  • Pandemics, health emergencies

In such cases, we may modify, cancel, or refund reservations as circumstances warrant.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of our Services constitutes acceptance of modified Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Governing Law: These Terms are governed by the laws of New York State, USA.

Jurisdiction: Any legal proceedings shall be brought in courts located in New York County, New York.
